DMCA Policy

QuizGen respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

1. Notification of Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our platform, please notify our copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, your notification must include the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit QuizGen to locate the material;
  4. Information reasonably sufficient to permit QuizGen to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notification, QuizGen will follow the DMCA's procedures for responding to claims of copyright infringement, which may include removing or disabling access to the allegedly infringing material and/or terminating accounts of repeat infringers.

2. Counter-Notification

If material that you have posted to our platform has been removed or disabled in response to a DMCA notification, and you believe that the material was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our designated agent.

To be effective, your counter-notification must include the following information:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which QuizGen may be found, and that you will accept service of process from the person who provided the DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, QuizGen will promptly provide the person who submitted the DMCA notification with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 to 14 business days. QuizGen will replace the removed material and cease disabling access to it within 10 to 14 business days following receipt of the counter-notification, unless our designated agent first receives notice from the person who submitted the DMCA notification that such person has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our platform.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, QuizGen has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. QuizGen may also, at its sole discretion, limit access to our platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

4. Accommodation of Standard Technical Measures

QuizGen accommodates and does not interfere with standard technical measures that are used by copyright owners to identify or protect copyrighted works and that have been developed according to a broad consensus of copyright owners and service providers in an open, fair, voluntary, multi-industry standards process, are available to any person on reasonable and nondiscriminatory terms, and do not impose substantial costs on service providers or substantial burdens on their systems or networks.

5. AI-Generated Content

As a platform that uses artificial intelligence to generate educational content, QuizGen respects the intellectual property rights that may exist in the training data used by our AI systems. We take several measures to ensure our AI-generated content respects copyright law:

  • Our AI systems are designed to generate original content rather than reproduce existing copyrighted material.
  • We instruct users not to use our platform to generate content that infringes on others' intellectual property rights.
  • We actively monitor and review the content generated on our platform to detect and prevent potential copyright infringement.

However, the legal landscape around AI-generated content is still evolving. If you believe that our AI systems have reproduced your copyrighted work in a manner that constitutes copyright infringement, please follow the DMCA notification process outlined above.

6. Educational Material and Fair Use

QuizGen is an educational platform, and many uses of copyrighted material for educational purposes may constitute fair use under copyright law. The fair use doctrine permits limited use of copyrighted material without authorization from the copyright holder for purposes such as criticism, comment, news reporting, teaching, scholarship, or research.

However, fair use is a complex and fact-specific analysis, and we encourage our users to respect copyright law and obtain proper permissions when necessary. If you have questions about whether your use of material on our platform constitutes fair use, we recommend consulting with a legal professional.

7. User Generated Content

Users of QuizGen's platform may upload or input text and other content to generate quizzes and educational materials. By using our services, users represent and warrant that they have the necessary rights or permissions to use and share such content, and that such use does not infringe on any third party's intellectual property rights.

If you are a user, please ensure that you have the right to use any content you upload to our platform. This includes obtaining necessary permissions or ensuring that your use falls under exceptions such as fair use.
